General Terms and Conditions of Winner’s Club

These general terms and conditions govern the contractual relationship between SEMALU SRL – Winner’s Club (BCE: 0425.229.390), hereinafter referred to as “Winner’s Club”, and its clients, hereinafter collectively referred to as the “Clients” and individually as the “Client”.

1. Scope and Enforceability

These general terms apply to all memberships, subscriptions, classes, and services offered by Winner’s Club. By registering or using our services, the Client unconditionally accepts these terms. They are permanently available on the Winner’s Club website (https://winners-club.be).

2. Membership Fee

Any Client wishing to subscribe must pay a membership fee (currently free as of 01/09/2024). This fee applies for the entire duration of the subscription and is non-refundable. In case of termination, any re-registration is subject to a new membership fee.

3. Subscriptions

Winner’s Club offers several types of subscriptions (monthly, annual, All-In). Subscriptions are strictly personal, non-transferable, and subject to the following conditions:

a. Monthly and Annual Subscriptions
Subscriptions may be purchased online or on-site. Monthly subscriptions automatically renew until canceled by the Client, with one month’s notice. Annual subscriptions are payable in full and non-refundable in case of early termination.

b. All-In Subscription
The All-In subscription grants access to all sports facilities (fitness, group classes, yoga), except squash courts, which require separate booking and payment.

c. Pricing and Activation
Details of subscription types and pricing are available on the Winner’s Club website (https://winners-club.be/tarifs). Subscriptions are activated upon registration.

d. Modification and Termination
Winner’s Club reserves the right to suspend or terminate any subscription in case of fraud or breach of internal regulations.

4. Right of Withdrawal

Subscription purchases are final and non-refundable. However, if purchased online, the Client has a 14-day withdrawal right, unless the service has been used during this period.

5. Payment of Monthly Subscriptions

By subscribing to a monthly plan, the Client authorizes an automatic direct debit (SDD) each month. Upon activation, a prorated fee for the remaining days of the current month must be paid immediately.

Subsequent debits are processed during the first week of each month. In case of a failed debit, Winner’s Club will attempt collection again. Repeated failures may lead to credit card recovery procedures or other methods, after a reminder notice.

Winner’s Club may charge €20.00 for each failed debit (e.g., SEPA rejection due to insufficient funds). If the Client fails to respond within 14 days of the reminder, a formal notice will be issued. Continued non-payment within 14 days entitles Winner’s Club to terminate the contract automatically.

Termination does not waive Winner’s Club’s right to recover outstanding amounts, either amicably or legally. In case of late payment, all amounts become immediately due, increased by 2% monthly interest plus €10 reminder fees. Winner’s Club may deny access to facilities until payment is settled, without suspending the subscription.

6. Suspension of Subscription

Subscriptions may only be suspended for medical reasons, upon presentation of a medical certificate, for a minimum of one month. During suspension, facility access is disabled.

7. Termination of Subscription

a. Annual Subscription
Annual subscriptions cannot be terminated before expiry. Exceptionally, early termination may be granted in case of relocation or medical reasons, with proof.

b. Monthly Subscription
Clients may cancel their monthly subscription with one (1) month’s notice, starting from receipt of the request by email (info@winners-club.be).

12-Month Commitment
To benefit from a preferential rate, the Client commits for a period of 12–6–3 months from registration. Early termination requires one month’s notice. If canceled before the end of the commitment, the Client must pay all remaining months.

c. Termination by Winner’s Club
Winner’s Club may terminate any subscription if the Client’s behavior harms other members’ experience or violates these terms or the internal regulations.

d. Student Subscription
Winner’s Club offers a discounted 12-month subscription for students. Early cancellation follows the same rules as above. Non-compliance may lead to legal recovery proceedings, with possible additional costs charged to the Client.

8. Subscription Changes During the Year

Clients wishing to upgrade or downgrade their subscription must notify Winner’s Club by email (admin@winners-club.be). A one-month notice applies, starting the first day of the following month.

9. Internal Policy and Class Participation

Group classes are available only to members with a valid subscription. Internal rules and booking policies are accessible here: [link].

10. Children’s Courses and Camps

a. Camps and Fees
Children’s camps require a separate fee and are offered during school holidays. Registrations are final and non-refundable.

b. Reservations and Access
Class bookings (group sessions and climbing courses) can be made online. As spots are limited, early booking is recommended.

11. No-Show and Class Cancellations

Any reserved class must be canceled at least two hours before the scheduled start time to free the spot.

12. Amendments to Terms and Pricing

Winner’s Club reserves the right to amend these terms and subscription prices. Clients will be notified one month in advance. In case of disagreement, the Client may terminate their subscription with three months’ notice.

13. Facility Use and Guests

Members may invite one guest for a free trial session. Guests must comply with internal rules. Some facilities may be temporarily unavailable for maintenance. Winner’s Club accepts no liability for such unavailability.

14. Minimum Age and Access

Clients must be 18 or older to register and use facilities independently. Minors are only allowed in supervised courses or camps.

15. Liability and Safety

Winner’s Club is not liable for personal belongings left on-site. Clients are responsible for their own safety and confirm having the appropriate physical condition for chosen activities.

16. Force Majeure

In case of force majeure preventing access to facilities, alternatives such as online classes may be offered. This does not affect subscription terms.

17. Personal Data

Winner’s Club complies with GDPR. Data requests may be addressed by email (admin@winners-club.be). Clients consent to the use of photos taken in the Club unless they request otherwise.

18. Intellectual Property

All intellectual property rights on content, logos, names, and services belong to SEMALU SRL. No reproduction or use is permitted without prior consent.

19. Invoicing

Clients requesting a quarterly invoice for their company must submit a request by email (admin@winners-club.be) with company details.

20. Internal Regulations

The internal regulations are displayed at the entrance of Winner’s Club. All Clients must comply to ensure a pleasant environment.

21. Governing Law and Jurisdiction

These terms are governed by Belgian law. In case of dispute, parties agree to seek an amicable solution before legal action. If necessary, Brussels courts have jurisdiction.
